Filing for a Marriage License

Marriage Intentions must be filed with the Westport Island Town Clerk if both parties intending to be married live on Westport Island and intend to be married in Maine.  Marriage Intentions may be filed with the Westport Island Town Clerk if one party to a marriage to take place in Maine resides on Westport Island, or if both parties are from out of state and intend to be married in Maine.

Information to have Available

Some of the information needed to complete the worksheet are the names, residence, place of birth, date of birth of both parties, and the names and place of birth of their parents. If either party has been married previously, a certified copy of the death or divorce decree -- whichever ended the previous marriage, must be presented to the clerk prior to the issuance of the marriage license. Photocopies are not accepted.

The Clerk will require proof of identity, e.g. driver's license, passport or state I.D.  for each party.

Once Marriage Intentions are filed and the license is issued, the parties are free to marry anywhere within the State of Maine. The license is valid for a period of 90 days from the date the intentions are filed.

Filing Fee

The filing fee is $40.

Obtaining Certified Copies

Once the wedding ceremony is complete and the Town Clerk receives the marriage license back from the officiant, the Clerk will record the marriage and the record of marriage will be filed at the Town Office and with the State. The couple may obtain a Certificate of Marriage from the Clerk, which will be needed for a name change on a driver's license, passport, bank account, social security card, etc. as well as for other legal documents.

A certificate is not automatically sent without prior arrangement and payment to the Town.  The fee is $15.00 for the first copy and $6.00 for each additional copy requested at the same time. For example, two copies ordered at the same time would cost $21.00.
